2. Builders Finish Supply delivers to curb only.  If arrangements have been made between Builders Finish Supply and a customer to have assistance with unloading material, and such agreed upon assistance is not available at the time of delivery, The Builders Finish Supply  driver will return to our location with the material, and the delivery fee will be forfeited.

3. Builders Finish Supply shall not be liable for any loss or damage in the event that we are unable to make delivery for reasons beyond our control.  We will not make deliveries in inclement weather, or if we determine that traffic conditions or time of day will render the delivery undesirable.

4. These terms stated herein, together with copyright agreements attached to this web site, constitute the entire agreement between Builders Finish Supply and the purchaser of goods, and no statements or representations, verbal or in writing, other than herein set forth, are part hereof, except where the parties hereto execute a material contract. Builders Finish Supply  shall not be bound by any representation, promise, or inducement not herein set forth in that lumber and materials contract.

 5. Builders Finish Supply will, at our expense, supply materials as specified in exchange for defective merchandise, or merchandise which does not conform to specifications herein, if any, but its liability does not extend beyond this.  Builders Finish Supply shall not be responsible for consequential damage, and disclaims all express and implied warranties unless specifically set forth herein in writing.  If performance by Builders Finish Supply  shall be delayed, prevented, or made impracticable, because of acts of God, government, war, riot, fire, flood, accident, delay of carrier, inability to procure merchandise from our usual normal sources of supply or transportation, or by any cause beyond the control of the Builders Finish Supply, we will damage or delay occasioned thereby.

6. Any claims made by the buyer regarding any sale of merchandise must be made in writing within ten days after delivery of the merchandise hereunder.  Failure to present such claim within such time shall constitute a waiver of such claim, and Builders Finish Supply shall not be further liable.

7. Stock items in good saleable condition may be returned, WITH A SALES RECEIPT FOR THE MERCHANDISE PURCHASED, and will be credited according to grade after deducting sales tax expense, expense of reloading and cartage.  A minimum 25% restocking charge shall be applied to all returned merchandise, unless waived totally or in part by an acting Sales Manager.  If a check or credit card was accepted as payment, Builders Finish Supply will issue credit after fourteen business days from date of said acceptance.  No credit will be allowed for special orders or detailed millwork.  Builders Finish Supply shall not be liable for materials stolen, damaged, or weathered due to any delay in making a pick up of material to be returned for credit.

8. Items to be delivered and requiring delivery at time of payment will not be unloaded until payment has been received.  If buyer's agent is not on site as agreed to receive delivery, merchandise will be returned undelivered to Builders Finish Supply, and buyer shall be charged for unsuccessful delivery.  No merchandise may be returned after six months from purchase date.

9. TERMS OF SALE- Sales on credit are made according to signed credit agreement.  Credit card sales are made subject to approval of card processing centers.  Payment by check subject to our requirements of 1) check being drawn on a local bank, 2) buyer in possession of a valid California Drivers' license and two major credit cards, 3) customer's address and phone number imprinted on the face of the check, 4) verification of funds on deposit.  Builders Finish Supply cannot accept second party checks.  Buyer shall pay collection costs of overdue accounts including reasonable attorney's fees, if any.  Returned checks are subject to a $25.00 service charge.

10. Any merchandise or milling purchased on account will be invoiced to the customer on the day it is received by or finished by the Builders Finish Supply,  unless specific arrangements have been made otherwise.  Items held by HARDWOOD CENTER beyond forty five (45) days past date of completion are subject to sale and any deposit placed on said items or milling shall be forfeited to Builders Finish Supply .

11. Builders Finish Supply MAKES NO STATEMENT WHATSOEVER REGARDING THE APPEARANCE OF WOOD AFTER IT HAS BEEN FINISHED BY THE PURCHASER, OR ANYONE EMPLOYED BY THE PURCHASER.  Wood is a natural product and subject to shrinkage, warping, infestation, dry rot, cracking, and defects invisible until it has been milled.  Significant color and grain variation are common between different pieces of lumber or lumber products, or even within the same piece of lumber or lumber product.  The finishing process often accentuates color and grain differences.  No warranty whatsoever is made, either expressly or implied, involving the behavior or appearance of lumber or lumber products while in the hands of the purchaser or anyone in the purchaser's employ.

12. Builders Finish Supply is not a party to, and will not be a party in any way, stated or implied, to any transaction between the purchaser of products or services from Builders Finish Supply and the subsequent sale of said products or services to any other person or entity. Builders Finish Supply has absolutely no relationship whatsoever, except with the original purchaser, and is bound by no other agreements or representations other than those stated herein, and applying only to the original purchaser from Builders Finish Supply.
